JUDGE STAYS ORDER TO REINSTATE WILCOX

When Gwynne Wilcox was illegally fired via email on February 28th, she immediately brought forward a lawsuit to override her dismissal. A judge agreed with her, and reinstated her on March 6th.

The Trump administration appealed, and on Friday, March 28th, The DC Court of Appeals issued a stay on her firing, leaving the NLRB once again without quorum.

"The people elected the president to enforce the nation's laws, and a stay serves that purpose by allowing the people's chosen officer to control the executive branch," Judge Justin Walker, who was appointed by Mr. Trump in his first term, wrote in an opinion siding with the administration.

Just three weeks ago a district court judge Beryl A Howell, wrote in the ruled Wilcox’s firing unconstitutional, writing, “The framers of the US constitution made clear that no one in our system of government was meant to be king – the President included – and not just in name only”.While this stay was granted when the Trump administration asked for it while the DC Circuit considers the case, Judge Patricia Millet, appointed by former President Barack Obama, dissented from the court's decision to grant a stay.

"The whole purpose of a stay is to avoid instability and turmoil. But the court's decision today creates them," she wrote.
